Terms of service.
By accessing and using these Services, you accept and agree to be bound by the terms of this agreement as defined below.
Definition
Agreement means the quotation, acceptance and the following terms and conditions.
You or Client means the dog’s owner, carer, individual who is engaging the Trainer’s services.
Trainer or I means Lisa at North Yorkshire Dog Training.
Consultation Form means the form provided by the Trainer at the time of booking a Session requiring Client completion.
Session means the booked time for the provision of Services.
Amendments means any alterations to the work.
Work’ or works means behaviour consultations, training, handouts, written report, behaviour programme, training program created by North Yorkshire Dog Training. It may also describe other services such as administrative, training meetings and other tasks which are necessary in the creation of the program.
Entire Agreement
These terms and conditions apply to all services by Lisa at North Yorkshire Dog Training, to the exclusion of any other terms unless otherwise agreed in writing.
They reserve the right to update these Terms and Conditions at any time by notice and with immediate effect.
These terms and conditions shall prevail over all terms and conditions of your customary practice or any previous course of dealings the client has had with North Yorkshire Dog Training.
These terms and conditions apply to all work created by North Yorkshire Dog Training. Work services or products are only supplied in strict accordance with these terms and conditions.
These terms and conditions shall be subject to English Law.
The contents contained in the quotation (verbal or written) and these Terms and Conditions form the agreement between North Yorkshire Dog Training and the Client relating to the work, no variation on them will be binding to North Yorkshire Dog Training unless it is agreed in writing and signed by North Yorkshire Dog Training (Lisa Whitehouse).
Each clause of this Agreement is independent and operates separately in its own right.
By agreeing to these terms and conditions your statutory rights are not affected.
Should North Yorkshire Dog Training decide to waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit North Yorkshire Dog Training to waive the same clause on any other occasion.
Any alterations or variations of these terms and conditions shall be inapplicable unless agreed in writing by all parties concerned before commencement of any work.
Ordering services or using work created by North Yorkshire Dog Training is automatically agreeing to these terms and conditions.
This contract shall be governed by the laws of England and both parties shall submit to the non-exclusive jurisdiction of the English courts.
Trainer Responsibilities
I use balanced training methods. However, results are never instant and require the Client’s commitment to work with their dog in the long-term.
I cannot guarantee that the training will work because each dog is an individual case with different behavioural and training issues and a different background.
The training that I use will be tailored for your dog based on the information you provide to me, including via the Consultation Form.
I am not responsible for providing a stooge dog, if this is recommended for progressing the training or behaviour therapy.
I will apply personal judgement and will cut short a Session, if necessary, because of extreme weather conditions, including but not limited to: excessive heat, torrential rain, thunderstorms and snow or ice. The decision to do so lays with the Trainer using their personal judgement, for the safety of themselves, their Client and Client’s dog, members of the public, and other animals.
In the event of a pandemic, I will adhere to the safety measures advised by the UK governing body at the time of the session.
Client Responsibilities
It is your responsibility to fully and honestly complete the Trainer’s Consultation Form and send it to the Trainer at least 72 hours in advance of your Session. The Trainer accepts no responsibility for matters not disclosed on the Form. The Session will not proceed without the Consultation Form having been completed.
You will inform the Trainer before any Training Session regarding any updates to the information previously provided in the Consultation Form. This includes but is not limited to: medical information, dog behavioural changes, homing situation or ownership of the dog and legal matters relating to the dog for example a Court order.
You confirm that the dog is not subject to the Dangerous Dog Act 1991, is not subject to a Court Order and is lawfully in your care.
Your dog must be fully vaccinated and on a regular flea and worm control regime. You will provide proof of vaccinations upon request. You are fully responsible for the good health and timely vaccination status of your dog and will seek professional medical assistance from your veterinarian. The Trainer is not qualified to provide any medical or vaccination advice.
In the case of behavioural issues, you are happy for us to contact your vet on your behalf. It is your responsibility to obtain a Vet Check for your dog if this is recommended by the Trainer.
The training that I provide will be specific to the dog that you have consulted me on. It is not designed for and should not be used for any other dogs without prior consultation with me regarding its relevance.
It is your responsibility to keep yourself, your family and visitors, and your dog safe. I am not responsible for injuries or damage to you, your dog or personal property. Your dog must be kept on a lead during training unless agreed with the Trainer.
You are responsible for all vet bills, no matter how they are incurred.
You must keep your dog under control during the Session. Failure to do so and any injury caused by your dog being out of control will be your full responsibility.
You are responsible for bringing any recommended equipment advised by the Trainer to the Session.
You will ensure your dog has a well-fitted and secure flat collar or harness with an ID tag.
If your dog is known to bite other dogs or cause injury then they must wear a well-fitting muzzle for the Session. The Trainer takes no responsibility for dogs not muzzled or not kept under control during the Session or when outside of the Session. Failure to wear a muzzle when asked may result in the immediate termination of services.
In some cases I may use a stooge dog to aid training. You will be responsible for keeping your dog at sufficient and safe distance from the stooge dog and if asked your dog will wear a muzzle during these sessions.
In the event of a pandemic, you agree to follow the measures put in place by the Trainer at the time of the Session. This may include bringing your own equipment such as leads, water bowls, treats and bed, or may involve conducting the Session over a video conference call such as Zoom.
You are happy for me to share success stories about your dog via social media, and share photos and videos taken during our session(s).
You will inform the Trainer before the Session if you have tested positive for Covid-19 on the day of the Session or in the 5 days prior to the Session.
General
Work created by North Yorkshire Dog Training is charged to the client at the agreed amount.
The full charge of the service is payable on the day of each session.
Deadlines set in the agreement will not affect North Yorkshire Dog Training right to be paid.
If work is cancelled the client shall reimburse North Yorkshire Dog Training for any and all losses arising. In the event that work is cancelled, ownership of the work remains the property of North Yorkshire Dog Training and the Client is not authorised to use any part of the work.
Ownership of the work shall not pass to the client until all charges have been paid in full.
All work created by North Yorkshire Dog Training for the client is to be used for the sole purpose for which it was created. The client does not have the right to resell work created by North Yorkshire Dog Training or repurpose it without written consent from North Yorkshire Dog Training.
North Yorkshire Dog Training is entitled to assign any or all of its rights and obligations included in this agreement to third parties.
North Yorkshire Dog Training will not be responsible for the creation of work which in any way contravene any existing Legislation and in particular the Trade Description Act 1968 and the Consumer Credit Act 1974.
North Yorkshire Dog Training reserves the right to refuse to provide service or create work at its own discretion.
North Yorkshire Dog Training cannot always guarantee to start work immediately.
If no timescale has been agreed for a service North Yorkshire Dog Training will not be responsible for any losses to the client if deadline is not met.
Once the work meets the terms of the quotation with its specifications any modifications to the work will be considered an amendment to the contract and charged accordingly.
Amendments to programmes and training/classes may incur an additional charge beyond that of the original invoice.
All amendments must be agreed by both North Yorkshire Dog Training and the client.
Amendments may exceed original deadlines agreed by North Yorkshire Dog Training and the client.
Behaviour and training programmes are completed within the agreed timescale– this is confirmed at time of booking.
Bookings
North Yorkshire Dog Training will send you a receipt when payment is made in full or first payment is received.
Whilst every care is taken to ensure the safety of both you and your dog whilst attending a session, please note that no responsibility can be accepted byNorth Yorkshire Dog Training for any injury to yourself or your dog, or any sickness or disease contracted whilst in the field or car park or premises.
Owners will not be permitted to use any piece of equipment in the session unless the trainer is present and they have been given guidance on how to use the equipment safely.
I have read the above conditions relating to training with North Yorkshire Dog Training and agree to be bound by them upon booking.
Payment
My fees are £85 per hour and £45 per half hour and will be set out in my written communication with you, quoted per dog. VAT is not chargeable.
My fees are exclusive of any out-of-pocket expenses. Any such expenses will be agreed with you in advance of being incurred.
A travel fee will be charged for travel to locations in excess of 5 miles (each way) from the Trainer's home. This fee comprises a 60p per mile/part mile fee (for each mile/part mile in excess of the aforementioned threshold) plus a £25 fee for each 15 minutes of travel time to/from the Trainer's home.
Payment is required in full at the end of each session.
North Yorkshire Dog Training expects payment in full by electronic bank transfer, online card payment or cash.
All quotes and tenders are valid for a period of thirty days.
Interest will be charged per day on all payments received outside of payment terms at the rate of eight per cent above the Bank of England Base Rate as applicable on the previous 31 December or 30 June whichever is the most recent.
Whilst outstanding payment is due North Yorkshire Dog Training reserves the right to withhold the designs, services or goods.
Any payment returned by the bank or card company will incur £10 admin charge as well as any charges made by the bank.
In case collection proves necessary, the client agrees to pay all fees (including all legal fees and court costs) incurred by that process. If for any reason whatsoever North Yorkshire Dog Training are unable to provide an agreed product or service in accordance with these terms and conditions our liability shall be limited in its entirety to a proportional refund of any fees paid by you for the service or product.
All administrative fees to third parties and the time taken to organise will be charged to the client irrespective of any quoted amount set out in the quotation with its specifications.
In the event that the Trainer provides a stooge dog for a Session, my fees are exclusive of any fees and travel fee charged by the stooge dog handler.
I do not offer refunds for cancelled services or missed Sessions unless in exceptional circumstances, to be decided at my discretion.
Where the Services include a Behaviour Consultation, the Second Consultation Session is to be taken within 4 weeks of the First Consultation, otherwise the Second Session will be forfeited.
Where a refund is issued, it will be paid back by the same method it was paid to the person who made the original payment.
Guarantee
North Yorkshire Dog Training shall create the agreed work for the use of the client. The client may use the work or works only in its original form and only for its original use for the animal named and described within the work.
Behaviour work cannot be guaranteed with any animal.
North Yorkshire Dog Training shall create behaviour and training programme to the specifications of the problems assessed at the first training session and will make amendments to the training and behaviour programme accordingly.
The training and behaviour programme is specific to the dog that the programme has been designed for and should not be used in part or whole with any third party.
The client shall agree not to sell, destroy, deface, alter or part with work created by North Yorkshire Dog Training or permit it to be given or done so by any third party.
Advice
The information and any treatment suggested consists of North Yorkshire Dog Training personal views and are based on the information given to North Yorkshire Dog Training by the client and or North Yorkshire Dog Training’s own conclusions resulting from personally gained evidence of the animal and the related behavioural problem.
Treatment plans, for the most part, will not be successful overnight. This requires a good deal of patience. North Yorkshire Dog Training cannot guarantee that this will work, as each animal is an individual case, nor is it possible to foresee if another problem may arise as a result of the treatment. All programs are specific to a certain animal and should not be tried on any other pet, only the animal whose name that appears on the information.
North Yorkshire Dog Training reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause. By booking you will agree to keep the date and time of the consultations. If changes to the date and/or time need to be altered by you, then 72 hours’ notice will need to be given, otherwise a charge of £20 will be incurred on top of the existing consultation fee.
Cancellation And Termination
North Yorkshire Dog Training may, by written notice, terminate any agreement at its discretion:
If the client fails to pay which has become overdue.
If the client breaches any of the terms of the agreement.
If North Yorkshire Dog Training discovers that the client’s use of work produced is unethical misleading or morally corrupt.
If the client’s use is in anyway harmful to North Yorkshire Dog Training or its reputation.
The client may cancel the agreement at anytime but may be invoiced up to the full amount quoted based on the degree to which the work has been completed and on the extent to which time has been allocated to the project that cannot be effectively used to generate revenue that would be otherwise lost.
If you wish to rearrange a Session, at least 72 hours notice must be provided to the Trainer. Failure to do so will result in a Cancellation Fee.
I reserve the right to cancel any Session (at any time and with immediate effect) if the dog does not respond well to the training plan (where the continuing of said Session is deemed, by me, to constitute a risk).
I reserve the right to cancel a booked Session at any time at my discretion due to unforeseen circumstances, including due to the implications of a pandemic.
Cancellations with less than 72-hour notice will incur a Cancellation Fee of 25% for that session, Payable Immediately. Less than 48-hour notice will incur a Cancellation Fee of 50% for that session, Payable Immediately. Less than 24-hour notice will incur a Cancellation Fee of 100% for that session Payable immediately.
A service will be deemed as cancelled if there is more than 30 days from the first training or consultation.
No refunds will be issued.
Liability
North Yorkshire Dog Training shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit.
North Yorkshire Dog Training will not be held responsible under any circumstances whatsoever to the Client for a lack of time, effort and circumstances from the work.
In no event will North Yorkshire Dog Training be liable to the client or any third party for damages or losses.
North Yorkshire Dog Training will not be liable for any loss, injury or liability to the client.
Handlers and/or owners remain responsible for their dogs at all times and are advised to ensure they have adequate pet or household insurance cover for liability in the unlikely event of damage or injury caused by their dog to property or to a third party.

The Trainer is not qualified to provide veterinary or legal advice and the information they provide is not intended to constitute such.
Comments and advice provided by others within Facebook groups or on Instagram may not be endorsed by the Trainer and should be treated accordingly.

You agree that you will not share training and behavioural materials provided to you by me as part of the Services to any other persons, apart from immediate family members for sole use with the dog for whom they were provided.

This privacy policy sets out how North Yorkshire Dog Training uses and protects any information that you give us when you use this website.
North Yorkshire Dog Training may change this policy from time to time by updating this page. Please make sure that you keep up to date with our policy details.
In order to process your enquiry and provide you with the best possible level of service, we may need to collect information for sending you information about our products and services. This may include your name, address, email address and telephone number. This information is in accordance of the GDPR 2018.
We would like to assure you that we are 100% committed to protecting your privacy and security.
We will not, under any circumstances, pass on any information we have collected about you to any third party. All personal information is held securely to ensure that no other party is able to view your details.
If you wish to check the information that we hold about you, you can do this at any time by emailing us. If the information is inaccurate, we will delete it or correct it immediately. We may request proof of identity before disclosing sensitive information to you.
We do not endorse sending ‘spam’ mail and will only send you information relevant to you regarding future dog training or behaviour events that we may be running.
The Trainer collects information from and about their Clients and their dogs for the sole purpose of providing their Services and may disclose this information to others as is necessary for the provision of said Services. This includes but is not limited to veterinarians with whom the Trainer would be reasonably expected to share information in the provision of Services. The Trainer shall accept no liability for any loss or inconvenience suffered by any party as a result of the disclosure of such information.
Communication
North Yorkshire Dog Training preferred method of communication is by email or phone. However, documents can be sent by traditional post, if no email address is available, this will incur a postal fee to send through reports to the client at the current postal rate and packaging.
North Yorkshire Dog Training shall not be held responsible for spelling mistakes or typing errors to any documents. Signatures are not required to start a contract; verbal communication, email or other exchanges are legally binding.

Each party agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement.
